Terms of use

Effective as of July 25, 2025

  1. ACCEPTANCE OF TERMS OF USE & PRIVACY POLICY

    a. These Terms of Use (the "Terms") govern your access to, and use of the mobile application named "Found" (the "App") owned and operated by PERIDOT Technologies, Inc. ("PERIDOT," "we," "us," or "our"), a Delaware corporation.

    b. By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these terms and our Privacy Policy, you are not authorized to access or use the App.

    c. PERIDOT reserves the right to modify these Terms and our Privacy Policy at any time. We will provide notice of any material changes through the App or by other means as determined by PERIDOT. Your continued use of the App after any such changes constitutes your acceptance of the new Terms and Privacy Policy.

  2. RELATIONSHIP TO PRIVACY POLICY

    a. These Terms of Use are intended to supplement and enhance the protections and provisions set forth in the PERIDOT Privacy Policy.

    b. To the extent there are any conflicts or inconsistencies between these Terms and the Privacy Policy, the Privacy Policy shall govern with respect to privacy matters, and these Terms shall govern with respect to all other matters.

    c. The Terms of Use address specific areas related to the use of the App, user conduct, intellectual property rights, and dispute resolution, which are not fully covered in the existing Privacy Policy.

    d. For information regarding how PERIDOT collects, uses, shares, and protects your personal information, please refer to our Privacy Policy, available at [[PRIVACY POLICY URL].]{.mark}

  3. ACCEPTABLE USE OF APP

    a. Lawful Use: You may only use the App for lawful purposes and in accordance with these Terms and the Privacy Policy. You agree to comply with all applicable local, state, national, and international laws, rules, and regulations in connection with your use of the App.

    b. Account Responsibility: You are solely responsible for any and all activities that occur under your account, including the content you post, upload, or transmit through the App. You must maintain the confidentiality of your account credentials and immediately notify PERIDOT of any unauthorized use of your account.

    c. User Verification: User acknowledges and agrees that use of the App may require identity verification through photo and identification document ("ID") submission. Access to certain or all features of the App may be contingent upon successful completion of the verification process. Verification may be denied if submitted materials are unclear, incomplete, or inconsistent with account information. User understands that verification procedures are implemented to confirm User's identity, prevent fraud, impersonation, and unauthorized account access, comply with applicable laws and regulations, and maintain the security and integrity of the App and its community. User consents to provide accurate, current, and complete information during the verification process, including but not limited to: 

    i.  Clear photographs of User's face ("Photo Verification");  

ii. Images of government-issued identification documents  ("ID Verification"); and  

iii. Any additional verification information that may  be reasonably requested.

By accepting these Terms of Use, User expressly authorizes and consents to:

i. The collection, storage, use, and processing of User's Photo Verification and ID Verification information;

ii. Automated and/or manual review of submitted verification materials;

iii. Comparison of submitted materials against User's account information; and

iv. Retention of verification data for the duration of User's account and for a reasonable period thereafter as required by law or for legitimate business purposes.

All verification information will be collected, stored, and processed > in accordance with our Privacy Policy and applicable data privacy > laws. Peridot reserves the right to request additional verification > information if initial submissions are insufficient.

d. Prohibited Conduct: You agree to use the App in a manner that does not interfere with or disrupt the normal operation of the App, or the servers and networks connected to it. This includes, but is not limited to, refraining from: 

i.  Attempting to gain unauthorized access to the App or its  related systems or networks;  

 ii. Using any automated means, including bots, scrapers, or  spiders, to access or use the App;  

 iii. Introducing any viruses, Trojan horses, worms, logic bombs,  or other harmful material to the App;  

 iv. Attempting to reverse engineer, decompile, or disassemble  any portion of the App; and  

 v.  Circumventing or attempting to circumvent any  technological measure implemented by PERIDOT to protect the App or  its content.

e. Prohibited Activities: You must not use the App to engage in any illegal or unauthorized activities, including but not limited to: 

i.  Harassing, defaming, intimidating, or threatening others;  

 ii. Promoting or facilitating illegal activities,  including terrorism, human trafficking, or illegal gambling;  

 iii. Infringing or violating the intellectual property  rights, privacy rights, or other rights of any third party;  

 iv. Transmitting any material that is defamatory, obscene,  indecent, abusive, offensive, harassing, or otherwise objectionable; and  

 v.  Impersonating any person or entity or falsely stating  or otherwise misrepresenting your affiliation with a person  or entity.

f. Suspension or Termination: PERIDOT reserves the right to suspend or terminate your access to the App at any time, with or without notice, for any violation of these Terms or the Privacy Policy, or for any other reason at PERIDOT's sole discretion. Upon termination, your right to use the App will immediately cease, and you must cease all use of the App and delete any copies of the App in your possession.

  1. USER CONTENT

    a. License Grant: By uploading, posting, or submitting any content to the App ("User Content"), you grant PERIDOT a royalty-free, non-exclusive, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, display, and otherwise exploit such User Content exclusively for and in connection with the operation and promotion of the App and PERIDOT's business, including the use of its generative artificial intelligence ("AI") technology, and in any media formats and through any media channels now known or hereafter developed. The license granted by User shall remain in effect for the duration that the User Content remain accessible through the App and for a reasonable period thereafter for archival, backup, and technical purposes.

    b. Avatar Generation: In addition to the terms and conditions in Section 4(a), by uploading, submitting, or otherwise providing User Content to our service, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, adapt, create derivative works from, and display your User Content for the specific purpose of generating, through artificial intelligence technology, an animated avatar that resembles or represents you (the "Avatar"). We will not use the avatar for any other purpose other than those specified in this Agreement without obtaining additional consent, nor shall we sell your Avatar to ant third parties or use your Avatar for promotional purposes without your explicit consent. The license granted herein specifically permits us to: 

    1.  Process your User Content through our  artificial intelligence systems;  

2.  Generate an animated Avatar based on your likeness  or characteristics;  

3.  Store your User Content and resulting Avatar as necessary  to provide the App's service; and  

4.  Display your Avatar within our App as directed by you.

    c. Media: By uploading, posting, or otherwise making available any photographs, images, graphics, video recordings, audio recordings, or visual content ("Media") through the App, User grants to us a non-exclusive, royalty-free, worldwide, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such Media in connection with providing and promoting the App. User agrees not to upload, post, or otherwise make available any Media that: 

    i.  Contain nudity, sexually explicit, obscene, or  pornographic material;  

ii. Depict violence or graphic content;  

iii. Promote discrimination, bigotry, racism,  hatred, harassment, or harm against any individual or group;  

iv. Infringe any patent, trademark, trade secret, copyright,  or other intellectual property rights of any party; or  

v.  Violate any applicable local, state, national,  or international law or regulation.

    d. Representations and Warranties: You, as a User, represent and warrant that: 

    i.  You own or have the necessary rights, licenses,  consents, and permissions to the User Content you provide and to  grant the rights and licenses described in these Terms;  

ii. The User Content does not violate these Terms, the  Privacy Policy, or any applicable laws or third-party  rights, including intellectual property rights, privacy  rights, publicity rights, or contractual rights; and  

iii. The User Content does not contain material that is  false, misleading, defamatory, obscene, indecent,  abusive, offensive, harassing, violent, hateful, inflammatory,  or otherwise objectionable.

    e. Content Monitoring: PERIDOT reserves the right, but not the obligation, to pre-screen, monitor, refuse, or remove any User Content that, in our sole discretion, violates these Terms, the Privacy Policy, or is otherwise objectionable. PERIDOT assumes no liability for any User Content posted, stored, or uploaded by you or any third party, or for any loss or damage thereto.

    f. Feedback: If you provide PERIDOT with any feedback, suggestions, or ideas regarding the App ("Feedback"), you grant PERIDOT an unlimited, irrevocable, perpetual, sublicensable, transferable, royalty-free right to use such Feedback for any purpose without compensation or attribution to you.

  2. SUBSCRIPTION AND PAYMENT TERMS

    a. Subscription Options. The App offers various subscription plans ("Subscription Plans") that provide access to premium features and content. Details regarding the features, limitations, and pricing of each Subscription Plan are available on the App's subscription page, which is incorporated by reference into these Terms.

    b. Payment Terms: User agrees to pay all fees associated with the selected Subscription Plan in accordance with the billing terms in effect at the time of purchase. All payments shall be made in U.S. dollars and are subject to applicable taxes as required by law. User authorizes us to charge the payment method provided for: 

    i.  The initial subscription fee at the time of purchase;  

ii. Recurring subscription fees at the beginning of each  billing cycle;  

iii. Any applicable taxes; and  

iv. Any other charges incurred in connection with  User's account.

    c. Billing Cycles and Automatic Renewal: Subscription Plans are offered on a monthly, quarterly, or annual basis, as selected by User at the time of purchase. Unless User cancels at least 24 hours before the end of the current billing period, the Subscription Plan will automatically renew for the same duration at the then-current rate. User acknowledges that the amount charged may vary due to promotional offers, changes in Subscription Plans, or changes in applicable taxes, and User authorizes us to charge for such varying amounts.

    d. Cancellation and Refunds: User may cancel their Subscription Plan at any time through their account settings or by contacting customer support. Cancellation will take effect at the end of the current billing period, and User will continue to have access to subscription benefits until that time. We do not provide refunds or credits for partial subscription periods or unused subscription time, except where required by applicable law.

    e. Price Changes: We reserve the right to change subscription fees at any time, provided that any price changes will apply to billing periods commencing after notice of the change has been provided to User. Notice of price changes will be provided to User via email at least thirty (30) days before implementation.

    f. Payment Processing: We use third-party payment processors to facilitate payment transactions, and User's use of such services is subject to the applicable third-party terms and conditions. User agrees to provide current, complete, and accurate billing information and to promptly update all information to keep the account current, complete, and accurate.

    g. Delinquent Accounts: If payment cannot be charged to User's payment method or if a charge is refunded for any reason, we reserve the right to either suspend or terminate User's access to the subscription features. User remains responsible for any uncollected amounts and any costs incurred in connection with the collection of these amounts, including, without limitation, collection agency fees, reasonable attorneys' fees, and arbitration or court costs.

  3. INTELLECTUAL PROPERTY

    a. Ownership: The App and all of its content, features, and functionality, including but not limited to all information, software, text, displays, images, video, audio, design, selection, arrangement, and look and feel, are owned by PERIDOT, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

    b. Limited License: Subject to your compliance with these Terms, PERIDOT grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App solely for your personal, non-commercial purposes. This license does not include any right to: 

    i.  Modify, copy, distribute, transmit, display,  perform, reproduce, publish, license, create derivative works  from, transfer, or sell any information, software, products,  or services obtained from the App;  

ii. Use any data mining, robots, or similar data gathering  or extraction methods;  

iii. Download or copy any account information for the benefit  of another party; or  

iv. Use any meta tags or any other "hidden text"  utilizing PERIDOT's name or trademarks.

    c. Trademarks: The PERIDOT name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of PERIDOT or its affiliates or licensors. You may not use such marks without the prior written permission of PERIDOT. All other names, logos, product and service names, designs, and slogans on the App are the trademarks of their respective owners.

    d. Copyright Infringement: If you believe that any content on the App infringes upon your copyright or other intellectual property rights, please provide PERIDOT's Copyright Agent with the following information: 

    i.  An electronic or physical signature of the person  authorized to act on behalf of the owner of the copyright or  other intellectual property interest;  

ii. A description of the copyrighted work or other  intellectual property that you claim has been infringed;  

iii. A description of where the material that you claim  is infringing is located on the App;  

iv. Your address, telephone number, and email address;  

v.  A statement by you that you have a good faith belief  that the disputed use is not authorized by the copyright  or intellectual property owner, its agent, or the law; and  

vi. A statement by you, made under penalty of perjury, that  the above information in your notice is accurate and that  you are the copyright or intellectual property owner  or authorized to act on the copyright or intellectual  property owner's behalf.

  1. THIRD PARTIES

    a. Third-Party Links: The App may contain links to third-party websites, applications, or services that are not owned, controlled, or operated by PERIDOT ("Third-Party Services"). These links are provided solely as a convenience to you and do not constitute an endorsement by PERIDOT of the content on such Third-Party Services.

    b. No Control or Liability: PERIDOT has no control over and assumes no responsibility for the content, privacy policies, terms of use, or practices of any Third-Party Services. PERIDOT does not warrant or make any representations regarding the quality, accuracy, merchantability, or fitness of any products, services, or information provided by any Third-Party Services.

    c. Use at Your Own Risk: Your use of such Third-Party Services is at your own risk and subject to the terms and conditions of use and privacy policies for such Third-Party Services. We strongly advise you to read the terms and conditions and privacy policies of any Third-Party Services that you visit or use.

    d. Integration with Third-Party Services: The App may allow you to integrate or connect with certain Third-Party Services. By using such integrations, you authorize PERIDOT to access and use your accounts on such Third-Party Services on your behalf as permitted by the functionality of the App and the applicable Third-Party Services.

  2. LIMITATION OF LIABILITY AND DISCLAIMERS

    a. Disclaimers: THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE. PERIDOT DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED. PERIDOT DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE APP IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.

    b. Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PERIDOT, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF PERIDOT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: 

    i.  THE USE OR INABILITY TO USE THE APP;  

ii. UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR  TRANSMISSIONS OR DATA;  

iii. STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE APP; OR  

iv. ANY OTHER MATTER RELATING TO THE APP.

    c. Cap on Liability: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PERIDOT'S TOTAL LIABILITY TO YOU FOR ANY DAMAGES ARISING FROM OR RELATED TO THESE TERMS OR THE APP, FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE GREATER OF (A) THE AMOUNT PAID, IF ANY, BY YOU TO PERIDOT FOR THE APP IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR (B) $10,000.00.

    d. Exclusions: SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU.

    e. Basis of the Bargain: THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN PERIDOT AND YOU.

  3. INDEMNIFICATION

    a. Indemnification Obligation: You agree to indemnify, defend, and hold harmless PERIDOT, its affiliates, and its and their respective officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees and costs) arising out of or relating to: 

    i.  Your material violation of these Terms, the Privacy  Policy, or any applicable laws or regulations;  

ii. Your User Content or Feedback;  

iii. Your use or misuse of the App; or  

iv. Your material violation of the rights of any third  party, including but not limited to intellectual property  rights, privacy rights, or publicity rights.

A material violation is defined as when a party to this Terms of Use > or Privacy Policy fails to perform a significant or essential > obligation or duty to act.

b. Cooperation: You agree to cooperate as fully as reasonably required in the defense of any claim. PERIDOT reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you shall not in any event settle any matter without the written consent of PERIDOT.

  1. GOVERNING LAW & DISPUTE RESOLUTION

    a. Governing Law: These Terms, the Privacy Policy, and your use of the App shall be governed by and construed in accordance with the laws of the state of Delaware, without giving effect to any choice or conflict of law provision or rule whether of the state of Delaware or any other jurisdiction that would cause the application of the laws of any jurisdiction other than those of the state of Delaware.

    b. Dispute Resolution: Any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, or the App, or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules then in effect.

    c. Arbitration Procedures: The arbitration shall be conducted by a single arbitrator selected in accordance with the AAA rules. The arbitration shall take place in Wilmington, Delaware, unless the parties agree otherwise. The arbitrator shall apply the governing law as specified in [Section 10(a).]{.underline} The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

    d. Class Action Waiver: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND PERIDOT AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER PARTY ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION OR PROCEEDING. UNLESS BOTH YOU AND PERIDOT AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN MORE THAN ONE PERSON'S OR PARTY'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CONSOLIDATED, REPRESENTATIVE, OR CLASS PROCEEDING.

    e. Small Claims Court: Notwithstanding the foregoing, you may bring an individual action in the small claims court of your state or municipality if the action is within that court's jurisdiction and is pending only in that court.

    f. Injunctive Relief: Notwithstanding the foregoing, PERIDOT shall have the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of PERIDOT's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

    g. Time Limitation: Any claim or cause of action arising out of or related to these Terms, the Privacy Policy, or the App must be filed within two (2) years after such claim or cause of action arose or be forever barred.

  2. COMPLIANCE WITH LAWS

    a. Export Control Laws: You agree to comply with all applicable export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce, and trade and economic sanctions maintained by the Treasury Department's Office of Foreign Assets Control, in connection with your use of the App.

    b. Geographic Restrictions: PERIDOT makes no representation that the App is appropriate or available for use in locations outside the United States. If you access or use the App from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

    c. Children's Privacy: The App is not directed to children under the age of 13, and PERIDOT does not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on the App. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information.   3. SAFETY & REPORTING GUIDELINES

a. Commitment: We are committed to maintaining a safe environment for all Users of the App and have established these Safety & Reporting Guidelines to protect our community. User acknowledges that their safety while using the App is important and agrees to follow these guidelines to contribute to a secure environment for all Users.

b. Reporting Mechanisms: User agrees to promptly report any of the following through the App's designated reporting tools: 

i.  Violations of these Terms of Use or Code of Conduct;  

 ii. Content that appears to be unlawful, harmful,  threatening, abusive, harassing, defamatory, or otherwise objectionable;  

 iii. Suspected fraudulent activities or security vulnerabilities;  

 iv. Unauthorized access to User's account; and  

 v.  Any other safety concerns related to the use of the App.

c. Information Needed: Reports submitted by User shall include sufficient detail to allow us to investigate the reported issue, including but not limited to: 

i.  Description of the incident or content;  

 ii. Date and time of occurrence;  

 iii. Usernames or identifiers of involved parties, if  applicable; and  

 iv. Any additional information that may assist in our investigation.

d. Response: When responding to your report, we will: 

i.  Acknowledge receipt of User's report within a  reasonable timeframe;  

 ii. Investigate reported issues in accordance with our  internal procedures;  

 iii. Take appropriate action based on the results of  our investigation; and  

 iv. Notify User of the outcome when appropriate and permitted  by law.

User acknowledges that we may be required to report certain activities > to law enforcement authorities in accordance with applicable laws.

  1. MISCELLANEOUS

    a. Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and PERIDOT regarding the App and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and PERIDOT regarding the App.

    b. Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that comes closest to the intention underlying the invalid or unenforceable provision.

    c. No Waiver: PERIDOT's failure to enforce any right or provision of these Terms shall not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of PERIDOT. No waiver of any breach or default shall be deemed a waiver of any subsequent breach or default.

    d. Assignment: You may not assign or transfer these Terms, by operation of law or otherwise, without PERIDOT's prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. PERIDOT may freely assign or transfer these Terms without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.

    e. Notices: Any notices or other communications provided by PERIDOT under these Terms, including those regarding modifications to these Terms, will be given: (a) via email to the email address you provide to PERIDOT; or (b) by posting to the App. For notices made by email, the date of receipt will be deemed the date on which such notice is transmitted.

    f. Relationship of the Parties: Nothing in these Terms shall be construed as creating a partnership, joint venture, agency, or employment relationship between you and PERIDOT.

    g. Force Majeure: PERIDOT shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, natural disasters, war, terrorism, riots, civil unrest, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, shortages of transportation facilities, fuel, energy, labor or materials, or failures of telecommunications or internet service providers.

    h. Interpretation: The section titles in these Terms are for convenience only and have no legal or contractual effect. The word "including" means "including without limitation."

    i. Survival: The provisions of these Terms which by their nature should survive termination of these Terms shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, limitations of liability, and dispute resolution provisions.
